Unfortunately, sustaining a wrongful injury isn’t enough to recover compensation. Plaintiffs bear the burden of proof in personal injury lawsuits, meaning that the injured person is responsible for proving that the defendant’s actions resulted in their wrongful injury. Claimants must show by a preponderance of the evidence (e.g., that it is “more likely than not”) that liable parties are directly responsible. 

Negligence occurs when someone fails to exercise the level of care that a reasonable person would under similar circumstances, resulting in injury to another person.

Our Texas lawyers can help you prove negligence in your case by establishing these core elements: 

  1. Duty of Care: First, you must establish the defendant had a legal duty of care to uphold your safety and well-being.
  2. Breach of Duty: Second, you must prove that the defendant’s negligence or recklessness violated the aforementioned duty of care.
  3. Causation: Third, you must show that the defendant’s actions or inaction directly caused your injuries.
  4. Damages: Lastly, you must establish that the defendant’s negligence resulted in compensatory damages to you. 

Texas also follows a modified comparative fault rule, meaning a plaintiff can recover damages only if they are 50% or less at fault for their injuries. If the plaintiff is more than 50% at fault, they cannot recover any damages.

The following are other types of personal injury cases:

  • Strict Liability: Strict liability holds a defendant liable for certain actions regardless of intent or negligence. In Texas, strict liability often applies to cases involving abnormally dangerous activities, certain defective products, and animal attacks. This type of case applies to defective products, dangerous animals, and ultrahazardous activities (i.e. using explosives)
  • Intentional Torts: Intentional torts involve actions where the defendant intentionally caused harm or injury to the plaintiff. Unlike negligence, intent is a key element. Examples of such cases include assault and battery, false imprisonment, defamation, etc.

Other special considerations include:

  • Premises Liability: Property owners have a duty to maintain a safe environment. The level of care depends on the status of the visitor (invitee, licensee, or trespasser).
  • Workplace Injuries: Texas allows employers to opt out of workers' compensation, but those who do may face negligence lawsuits for employee injuries.
  • Medical Malpractice: Texas has specific rules, including caps on non-economic damages, governing lawsuits against healthcare providers.

  • Loss of Consortium: Compensation for the negative impact the injury has on the plaintiff’s relationship with their spouse or family, such as loss of companionship, affection, or sexual relations.
  • Loss of Enjoyment of Life: If the injury prevents the plaintiff from enjoying activities or hobbies they once did, they may be compensated for this loss.

In personal injury cases, "damages" refer to compensation that injured parties are legally entitled to pursue if they are harmed by negligence. Various types of damages can be recovered in Texas lawsuits, including:
