Nitrous Oxide Lawsuits

Investigating Claims Involving Nitrous Oxide Injuries and Deaths

Matthews & Associates is currently investigating potential claims involving nitrous oxide products sold in flavored canisters, tanks, and chargers under brand names such as Galaxy Gas, Whip-It!, and Baking Bad, including allegations that manufacturers and retailers sold these products with inadequate warning of the risk of nerve damage, paralysis, and death.

We are currently investigating potential claims involving:

  • People who suffered nerve damage, numbness, or paralysis after inhaling nitrous oxide products
  • People who suffered severe frostbite or burns from pressurized canisters
  • People who developed psychiatric symptoms requiring treatment after nitrous oxide use
  • Families who lost a loved one after nitrous oxide inhalation, oxygen deprivation, impairment, or related medical complications

If you or a loved one suffered a serious injury, or a loved one died, after using one of these products, our attorneys can review your situation and discuss whether you may have grounds to pursue compensation.

Injuries Linked to Nitrous Oxide Misuse

Nitrous oxide has legitimate uses in dentistry and as a whipped cream propellant, administered in small, controlled amounts. Recreational use often involves repeated inhalation of larger amounts over a short period. This can deprive the body of oxygen and interfere with the body’s ability to use vitamin B12, a nutrient the nervous system depends on.

Reported injuries include:

  • Nerve damage and neuropathy, including permanent numbness or weakness
  • Spinal cord degeneration and paralysis
  • Frostbite and cold burns from contact with pressurized canisters
  • Psychiatric symptoms, including psychosis, following heavy use
  • Loss of consciousness, seizures, and death from oxygen deprivation

In early 2025, the FDA issued a public advisory naming Galaxy Gas and similar brands, warning that recreational use had been linked to blood clots, paralysis, psychiatric symptoms, and death.

What Nitrous Oxide Lawsuits Allege

Depending on the facts, nitrous oxide claims may involve allegations such as:

  • Deceptive marketing. Products are branded and flavored to appeal to teens and young adults, then sold through smoke shops, vape shops, and online platforms rather than restaurant or culinary suppliers.
  • Failure to warn. Many canisters and tanks carry little or no warning about nerve damage, paralysis, addiction, or death.
  • Defective design. Nozzles and balloons sold alongside the product serve no purpose other than to facilitate inhalation, despite the product being marketed as food-grade.
  • False safety claims. Some brands have marketed products as approved for recreational use, though no such approval exists.

Where Nitrous Oxide Litigation Stands

Nitrous oxide litigation remains in an early stage. Publicly filed cases have named manufacturers, distributors, online sellers, and smoke shops, including claims against Galaxy Gas and related retail defendants in California and claims against Amazon and multiple nitrous oxide brands in Washington. These lawsuits generally allege that companies sold flavored, large-volume nitrous oxide products while failing to adequately warn consumers about neurological injury, addiction, oxygen deprivation, and death.

States have also begun to respond. Oregon's HB 3447, which took effect January 1, 2026, requires age verification for nitrous oxide sales, and Florida has proposed legislation to further restrict retail sales of these products.

We are actively reviewing claims and monitoring developments in this litigation.

Do I Have a Nitrous Oxide Lawsuit?

A case may be worth reviewing if:

  • You or a loved one used a flavored nitrous oxide product, including brands such as Galaxy Gas, Whip-It!, Baking Bad, Cosmic Gas, Miami Magic, HOTWHIP, InfusionMax, MassGass, or Smartwhip
  • You suffered nerve damage, paralysis, severe frostbite, or psychiatric symptoms requiring treatment
  • The injury required medical treatment, hospitalization, or ongoing care
  • A loved one died after using one of these products
  • You have documentation such as packaging, purchase records, or medical records related to your use

Not every case involving nitrous oxide use will qualify. These claims generally focus on serious, documented injury connected to a specific product and manufacturer. If you are unsure whether your situation qualifies, contact us. We can review the facts and give you an honest assessment.

What Compensation May Be Available

People seriously harmed by a defective nitrous oxide product may be entitled to pursue compensation for:

  • Past and future medical expenses, including neurological treatment and rehabilitation
  • Lost income and reduced future earning capacity
  • Pain, suffering, and diminished quality of life
  • Funeral and burial expenses in wrongful death claims

The value of a claim is tied to the harm it caused. Cases involving permanent nerve damage, paralysis, or death carry the most significant damages.

Filing Deadlines

Every state sets a statute of limitations, a deadline for filing a personal injury or wrongful death claim. These deadlines typically run between one and three years from the date of injury or the date a loved one died, though the exact window depends on your state and the nature of your claim. Cases involving minors, and cases where the connection between the injury and the product wasn't immediately clear, can follow different rules.

Given the variation in how different states treat these deadlines, and how quickly evidence like purchase records and store footage can disappear, contacting an attorney promptly is important.

Nitrous oxide claims are built on a combination of purchase records, product documentation, and medical evidence connecting a specific product to a specific injury. When we evaluate a nitrous oxide claim, we look at what product was used, where it was purchased, what injury occurred, and how the injury has affected your health and daily life.

Our attorneys at Matthews & Associates handle these matters on a contingency fee basis, which means there are no legal fees unless we recover compensation for you.
