Health Risks Linked to Kratom and 7-OH
Kratom comes from the leaves of Mitragyna speciosa, a tree native to Southeast Asia, and is sold as a powder, capsule, tea, or drink shot, often marketed as a natural alternative for pain relief, energy, or opioid withdrawal. Its active compounds, mitragynine and 7-hydroxymitragynine (7-OH), act on opioid receptors in the brain. Concentrated 7-OH products carry alkaloid levels far beyond what occurs naturally in the plant.
Reported injuries include:
- Liver failure or liver toxicity
- Cardiac complications, including abnormal heart rhythm or other serious cardiovascular events
- Respiratory failure and seizures
- Kidney failure
- Addiction and severe withdrawal symptoms
- Neonatal withdrawal syndrome in babies born to mothers who used kratom during pregnancy
The FDA has not approved any drug product containing kratom, mitragynine, or 7-OH, and the agency states that kratom is not lawfully marketed in the United States as a drug product, dietary supplement, or food additive. In July 2025, the FDA issued warning letters to companies marketing 7-OH products and announced steps to restrict concentrated 7-OH products. In July 2026, the DEA moved to temporarily place certain high-concentration 7-OH products and related substances into Schedule I.
What Kratom Lawsuits Allege
Depending on the facts, kratom and 7-OH claims may involve allegations such as:
- Deceptive marketing. Products are marketed as natural, safe, and non-addictive despite their opioid-like effects on the brain.
- Failure to warn. Labels frequently omit dosing guidance and any warning of overdose, addiction, or withdrawal risk.
- Design defect. Concentrated 7-OH products contain alkaloid levels far beyond what occurs naturally in kratom leaf, with no standardized dosing.
- Regulatory violations. Claims may also examine whether companies sold kratom or 7-OH products as supplements, foods, wellness products, or drug-like products despite FDA warnings and federal restrictions on unapproved products.
Where Kratom Litigation Stands
Kratom litigation has not yet consolidated into a single proceeding, but the volume and pace of cases are accelerating. Prior kratom wrongful death cases, including a reported $2.5 million Washington verdict and an $11 million Florida judgment, show that courts and juries have already been asked to hold kratom companies accountable for fatal injuries. Every case still depends on the product, warnings, toxicology evidence, medical history, and damages.
State enforcement has intensified as well. Missouri's attorney general sued a kratom retailer over 7-OH sales, citing state health data linking kratom to nearly 200 deaths statewide, and reached a settlement barring further 7-OH sales in the state. Texas's attorney general has sued a retailer for selling 7-OH products at concentrations far above legal limits. Kansas banned 7-OH products in April 2026, and a Utah law restricting kratom sales survived a federal court challenge in May 2026.
